I'm familiar with copyright laws and such, but I'd still like to avoid using brandnames if at all possible. From what I've read, it seems like it's a gray issue. There is an author on one my review forums who was heavily using the area he was familiar with and people advised him not to use national names of stores. On Mythbusters, they're always covering up the product names. It's not just because they're trying to keep people from knowing certain recipes to make dangerous things.
I'd rather avoid the issue all together. Now if I felt using the brandname would add something to my story, than that might be different. In this case, I'm not familiar with Blackberries anyway. But my character would use a PDA. At the time, I couldn't think of PDA. Of course, I don't know if that's what all the kids are using now-a-days. Perhaps the iPhone has replaced that. So if anyone knows about that, I'd like to hear from you.
