This is going to seem like a strange question, but I don't want to get sued after my book is published.
I want a Cemetery statue of a baby angel for the cover of my latest book. I plan on photographing the statue myself and using Photoshop to make the photo appear old and grainy.
I live in a small town with at least 100 cemeteries in my county, the majority of them small and forgotten. I plan on walking through the small cemeteries to find my angel. If I photograph someone's angel statue, can a Descendant, or relative of the person who's name is on that statue sue for not getting their permission first? I don't plan on snapping a photo of the name of the deceased person on the statue, I just want a side, or back view. I plan on distorting the image to make it look like the photo was taken in the 1800s. I asked my editor this question and he was stunned. He believes if the deceased has been gone for over a hundred years I should be good.
