Thanks very much for your advice.

You're right, Alan doesn't have a search warrant, and technically (I think) could be prosecuted for breaking and entering as well. He broke into Bob's house because he suspected that one of Bob's potential victims was being held there, and because several hours ago Cathy had gone in and not come out. I'm not sure if that counts (legally) as a good reason, although it may influence the jury somewhat.

I don't think Alan is going to lie about shooting Bob; besides, the body would be found outside, maybe fifty feet away from the house itself. Alan isn't conscious for long enough to move Bob, so that wouldn't work. He's going to be honest about it in a court of law.

After reading up on the definition of second-degree murder, I think that your last guess is probably correct. In New York, at least, the circumstances of the crime and the legal definition gel together perfectly, so I think that is probably what will happen to him.
